Everyone has a duty to take reasonable care for their own health and safety and for others in the workplace, especially the employer, who are also known as person conducting a business or undertaking (PCBU).
What is a PCBU?
A PCBU is a person that conducts a business or undertaking for profit or gain. This can include all types of working arrangements such as:
- self-employed people and sole traders
- companies
- each partner within a business partnership
- unincorporated associations
- government departments, authorities and local government councils
- public corporations.
What is not a PCBU
You are not a PCBU if:
- you are an elected member of a municipal council acting in that capacity
- you are a volunteer association that does not employ anyone
- you are a strata title body corporate that does not employ anyone, in relation to any common areas used only for residential purposes.
