MON 2: Notice of information about non-exploration mining operations

The mine operator of any mine is required to provide notice to the regulator no later than 45 days before the day on which mining operations commence at the mine.

Refer to rr. 675UC, 675UE of the Work Health and Safety (Mines) Regulations 2022.

Information required to be provided as part of this notice includes:

• information requested via SRS submission portal and the applicable pro forma
• details and description of the mining operations that will commence at the mine.

Depending on the nature of the mining operation, only the relevant part(s) of the application need to be completed. However, the items must be addressed in sufficient detail for the application to be properly assessed.

Additional information may be requested after the application is lodged under r. 675UE of the Work Health and Safety (Mines) Regulations 2022.

The mine operator of any mine is required to provide notice to the regulator no later than 30 days before the day on which additional mining operations commence at the mine.

Additional mining operations include:

• any mining operation that is significantly different from mining operations being carried out at the mine, e.g. commencing an underground mine where only open cut mining is currently conducted
• any mining activity that will result in a significant expansion of the mining operations at the mine compared with its current state
• introduces new or increased risks to health and safety associated with mining operations at the mine.

Additional mining operations do not include:

• operations that are exploration operations
• does not meet the description of an additional mining operation as defined by the regulator under rr. 675UC(2)(c)(ii) or 675UD(3)(c)(ii).

Information required to be provided as part of this notice includes:

• information requested via SRS submission portal and the applicable pro forma
• details and description of the additional mining operations that will commence at the mine
• a copy of the relevant changes to the mine safety management system. 

Depending on the nature of the mining operation, only the relevant part(s) of the application need to be completed. However, the items must be addressed in sufficient detail for the application to be properly assessed.

Additional information may be requested after the application is lodged under r. 675UE of the Work Health and Safety (Mines) Regulations 2022.
